The terms of the Agreement will change over time. If our Company makes minor changes to these terms without materially changing your rights, we will post the modified terms on our website at www.leveltechnology.com. Our Company will notify you by email, through the Product, or by presenting you with an amended Agreement to accept if we make a modification that materially changes your rights. When you use the Product after a modification is posted, you are confirming to us that the modified terms are acceptable.
Alerts and Notifications. As part of your use of Level™, you may receive notifications, text messages, alerts, emails, and other electronic communications. Your use of Level constitutes your agreement to the receipt of these communications. In particular, we may need to provide you with certain communications, such as service announcements and administrative messages. You are responsible for any messaging or data fees you may be charged by your wireless carrier. If you receive messages in connection with Level that are not required by law or required for proper use of Level, you will receive the option to opt out of such messaging in the future.
Dispute Resolution. By using Level, you agree that you shall not initiate any action to resolve any dispute, claim or controversy arising out of or relating to the purchase or use of Level prior to submitting such dispute for mediation in a jurisdiction to be agreed upon by you and VSP. You and VSP covenant to participate in the mediation in good faith and share equally in its costs, provided, however, that each party is responsible for its own cost of counsel and legal fees and expenses, including the retention of experts.
Termination. VSP reserves the right to suspend or deactivate your account or your access to certain aspects or all of Level, or to terminate these Terms, at our sole discretion, at any time and without notice or liability to you. Upon any such suspension, deactivation, or termination, we may delete or remove content and/or information related to your account. You may close your account at any time by contacting Level Customer Support. Upon any termination of these Terms of Use or suspension, termination, or discontinuation of Level or your account, the Privacy Policy, Warranty, and Dispute Resolution section of this TOU will survive.
